Tax deductions most companies miss on corporate Diwali gifts
This section saves money. Most finance teams know about Section 37(1) of the Income Tax Act, which allows business gifts as a deductible expense. Fewer know these specifics:
The ₹5,000 per person threshold. Gifts to employees below ₹5,000 in a financial year are tax-free for the employee under Section 10(10CC). Above that, the gift value gets added to their taxable income. For Diwali gifting, staying at or below ₹5,000 per person keeps everyone clean.
GST input tax credit recovery. If you buy tech gifts from a GST-registered vendor (like us) and receive a proper tax invoice, the 18% GST on electronics is fully recoverable as ITC under Section 16 of the CGST Act. On a 200-person order at ₹2,500 per head, that is ₹90,000 back.
The branded gift treatment. Gifts with your company logo embossed count as “business promotion expenditure” under Section 37(1), which has no per-person cap for deduction on the company’s end.
